These Terms form a binding agreement between you and WhereIsMyMind and govern your use of the WhereIsMyMind iOS app, this website, and the therapist portal. By using any of them you accept these Terms. If you do not accept them, please do not use the service.
For the iOS app, these Terms supplement Apple's App Store Terms of Service and the Licensed Application End User License Agreement (the "Apple EULA"). Where they conflict, the Apple EULA prevails to the extent of the conflict.
WhereIsMyMind is a personal mood-journaling app. By default it works locally on your device with no account required. You may optionally enable Cloud Sync to share entries with a clinician; this requires you to sign in with our identity provider, Clerk, and to accept our Privacy Policy. A future paid tier may gate Cloud Sync — we will tell you clearly before you incur any charge.
You must be at least 16 years old to use the service. The app is for personal, non-commercial use. Healthcare professionals using the portal must do so within the scope of an appropriate professional relationship and applicable laws and codes of conduct.
When you enable Cloud Sync or sign up for the therapist portal we create an account via Clerk. You are responsible for keeping your credentials confidential and for activity under your account, and for providing accurate information. You may delete your account at any time. We may suspend or terminate accounts that breach these Terms, pose a risk to others, or where the law requires it.

WhereIsMyMind is a wellness journaling tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. If you may be experiencing a mental-health emergency, contact your local emergency services or a crisis line such as Samaritans 116 123 (UK) or 988 (US).
If we introduce a paid tier for the iOS app, billing is handled by Apple via your Apple ID, and pricing, renewal, and cancellation are governed by the Apple EULA and the App Store. We do not collect or store your payment details.
The service, including its code, design, branding, and copy, is owned by us and our licensors. We grant you a limited, personal, non-transferable, revocable licence to use it in line with these Terms. You retain ownership of the entries you create; by using Cloud Sync you grant us a limited licence to store and transmit those entries solely to deliver them to your nominated clinician.
The service relies on Apple, Clerk, Evervault, and Supabase. Their terms and privacy policies apply to their handling of your data. A current list is maintained in our Privacy Policy.
We provide the service on an "as is" and "as available" basis and may modify, suspend, or discontinue features on reasonable notice. Local features remain available even when our backend is unreachable; Cloud Sync may pause until connectivity is restored.
To the maximum extent permitted by law, the service is provided without warranty of any kind. Our total aggregate liability is limited to the greater of the amount you paid us in the twelve months before the claim, or £100. We are not liable for indirect, incidental, or consequential losses. Nothing excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence.
You agree to indemnify us against claims, damages, and reasonable costs arising from your breach of these Terms, your unlawful use of the service, or content you upload that infringes another person's rights.

We may update these Terms from time to time; material changes affecting Cloud Sync users will be surfaced in-app and require acceptance. You may stop using the service at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, liability limits, indemnity, governing law) survive.
